Viyla – Terms of Service

Welcome to Viyla (“Viyla,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile interfaces, kiosks, QR placements, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
1. Overview of the Platform
Viyla operates an online directory and marketplace that enables users (“Users”) to discover, purchase, and/or book experiences, tours, attractions, and other services offered by independent third-party providers (“Vendors”).
Viyla does not own, operate, manage, supervise, or control the services offered by Vendors unless expressly stated otherwise. All contracts for services are between the User and the Vendor.
2. Eligibility
- Be at least 18 years old or the age of majority in your jurisdiction
- Have legal capacity to enter into binding agreements
- Provide accurate and complete information
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Nature of Viyla’s Role
Viyla acts solely as a marketplace intermediary and promotional platform. Viyla is not the operator, employer, partner, agent, or insurer of Vendors and is not responsible for supervising Vendor services.
5. Vendor Responsibilities
- Ensure accuracy of listings, pricing, and availability
- Comply with all laws, permits, and licensing requirements
- Maintain required insurance coverage
- Deliver services safely and professionally
- Honor confirmed bookings and issued vouchers
6. Purchases, Payments & Vouchers
Payments may be processed through third-party providers. Voucher purchases represent a prepaid right to redeem a Vendor’s service, subject to Vendor availability and applicable expiration terms.
Refunds and cancellations are subject to Vendor policy unless otherwise stated. Service fees may be non-refundable.

7. Refunds & Cancellations
Cancellation policies may vary by Vendor. Users are responsible for reviewing the specific cancellation terms prior to booking. Viyla may, but is not obligated to, assist in dispute resolution.
8. Commission & Vendor Fees
Vendors agree that Viyla may charge commissions on transactions. Commission rates and payout schedules are disclosed in the Vendor dashboard. Viyla may deduct processing fees, chargebacks, and disputes where applicable.
9. Hotel & Affiliate Partnerships
Viyla may promote listings through hotels, kiosks, QR placements, and affiliate partners. Affiliate compensation arrangements do not alter Vendor responsibility for service delivery.
10. Assumption of Risk
Participation in activities involves inherent risks. By booking through Viyla, you voluntarily assume all associated risks. Viyla is not responsible for injuries, damages, or losses arising from Vendor-provided services.
11. Limitation of Liability
To the fullest extent permitted by law, Viyla shall not be liable for indirect, incidental, consequential, or punitive damages. Total liability shall not exceed the amount paid by you to Viyla in the preceding 12 months.
12. Indemnification
You agree to indemnify and hold harmless Viyla and its affiliates from claims arising from your misuse of the Platform or Vendor-provided services. Vendors agree to indemnify Viyla for claims arising from their services.
13. Intellectual Property
All Platform content, including branding, software, and design elements, is owned by Viyla or its licensors. Unauthorized copying, scraping, or reproduction is prohibited.
14. Suspension & Termination
Viyla may suspend or terminate accounts, remove listings, or withhold payouts for violations of these Terms or suspected fraud.
15. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in courts located in Florida unless otherwise required by law.
16. Modifications
Viyla may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
